<p>The good news is that <a class="sbn-auto-link" href="http://www.sbnation.com/ncaa-football/players/115322/justin-mccay">Justin McCay</a> has finally been given a date which he can expect a final decision. The bad news is that it's still not going to happen until May 2. That's the date that Charlie Weis says McCay will finally find out whether or not he will be eligible to play for the <a class="sbn-auto-link" href="http://www.sbnation.com/ncaa-football/teams/kansas-jayhawks">Kansas Jayhawks</a> after appealing the initial ruling that left him without the necessary hardship waiver.</p>
<p>"The never-ending saga," <a href="http://www2.ljworld.com/news/2012/apr/29/ku-football-notebook-cummings-coming-along-backup-/">Weis said</a>. "But they told us by May 2. Just like I said last time, as soon as I hear something, he'll know about it first, and then I'll get it out there as quickly as I can."</p>
<p>McCay would add another impact transfer for KU in a season where they could desperately use him. The former Oklahoma Sooner wide receiver could seriously stretch the field for Weis' new pro-style offense under Dayne Crist. Adding a veteran wideout to team with the veteran quarterback could pay immediate dividends rather than waiting on freshmen to learn a system and adjust to the collegiate level.</p>

<p>Wide receiver Justin McCay's petition to play right away for Kansas was denied, but the school will appeal to a subcommittee. The decision will be made on May 1.</p> <p>Wide receiver <a class="sbn-auto-link" href="http://www.sbnation.com/ncaa-football/players/115322/justin-mccay">Justin McCay</a> decided to transfer from Oklahoma to Kansas so that he could be closer to his family. McCay is a former five-star prospect and in 2010 he redshirted his freshman year for Oklahoma and played sparingly this past season, and he decided to transfer to Kansas in order to be closer to his family.</p>
<p>McCay wanted to play right away so he applied for a hardship to do so, but his appeal was denied by the NCAA but McCay was told that if <a target="_blank" href="http://www.kuathletics.com/sports/m-footbl/spec-rel/042012aaa.html">the school wanted to appeal they could do so to a subcommittee</a>:</p>

<p> "We are disappointed in the NCAA staff's decision," said head coach Charlie Weis. "But we will take its advice and will appeal to the Subcommittee. We certainly hope that the members of the Subcommittee, who work day-to-day on campuses and in conference offices, will see Justin's situation for what it is and make a decision that is in his best interest."</p>

<p>The appeal will be made to the subcommittee on Tuesday April 24 and then a decision will be made on Tuesday May 1 at 5 p.m. If McCay win's the appeal he will be able to play in 2012 and have three years to play three seasons, but if the appeal is denied then he will have to sit out 2012 and have two years of eligibility left.</p>
<p>During spring drills McCay was listed as a backup wide receiver.</p>
